Moreover, in many cases, such deals between authors and industry are imbalanced, both financially and otherwise, in favor of intermediaries.\u201d<\/p>\n<p>That framing puts Salt-N-Pepa\u2019s lawsuit in a much bigger context.<\/p>\n<p>This isn\u2019t just about one group trying to reclaim their music. It\u2019s about how deals got structured and who actually benefited from them.<\/p>\n<p>The lawyers then break down why the law gives artists a path to fight back years later:<\/p>\n<p>\u201cTo remedy this inversion of constitutional benefits, Congress has always ensured that authors receive a second chance to control and benefit from the fruits of their labor. Under the Copyright Act of 1976 (the \u20181976 Act\u2019), that second chance is guaranteed through so-called \u2018termination rights,\u2019 which provide authors and their heirs an inalienable right to reclaim any copyright previously transferred or licensed away by the original author.\u201d<\/p>\n<p>That\u2019s the core of Salt-N-Pepa\u2019s case right there.<\/p>\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><d class=\"wp-block-embed__wrapper\"><br \/>\n<d class=\"jetpack-video-wrapper\"><span class=\"embed-youtube\" style=\"text-align:center; display: block;\"><iframe loading=\"lazy\" title=\"Salt-N-Pepa in fight against record label for music rights\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/gGugj_3Thxk?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe><\/span><\/d><br \/>\n<\/d><\/figure>\n<p>They\u2019re using termination rights to try to take back control of their recordings, and it\u2019s a legal move that\u2019s been sitting in the law books for decades.<\/p>\n<p>UMG\u2019s defense leans on the idea that the recordings were \u201cworks made for hire,\u201d which would keep ownership locked with the label.<\/p>\n<p>But the lawyers backing Salt-N-Pepa argue the lower court totally missed the mark on that issue:<\/p>\n<p>\u201cThe district court\u2019s Opinion and Order in favor of UMG purports to side-step the \u2018work made for hire\u2019 issue. But to do so, the court ignored a fundamental tenet of copyright law that, absent a legitimate \u2018work made for hire\u2019 relationship, the creator is the author and initial owner of a copyrighted work from the moment it is fixed in a tangible medium of expression.\u201d<\/p>\n<p>They\u2019re saying the court skipped over the key legal question and built its whole decision on that gap.<\/p>\n<p>The filing also draws a sharp line between artists and labels when it comes to who actually created the work:<\/p>\n<p>\u201cIn context, the most likely authors of a sound recording are the performers and, possibly, the producers who take an active role in shaping the sonic landscape by contributing meaningful creative expression to the recording. Conversely, given the purely logistical and financial role of record companies in the recording process, the label will rarely, if ever, be considered an author of an artist\u2019s sound recording.\u201d<\/p>\n<p>That language directly challenges the whole idea that a label can claim ownership just because it funded or controlled the process.<\/p>\n<p>The lawyers also warn that courts can\u2019t just rely on assumptions or contract language alone:<\/p>\n<p>\u201cResting on an implicit factual premise is, of itself, reversible error because, \u2018there must be findings, stated either in the court\u2019s opinion or separately, which are sufficient to indicate the factual basis for the ultimate conclusion.&#8217;\u201d<\/p>\n<p>And they push back even harder on a common industry tactic:<\/p>\n<p>\u201cWhat the district court in this case missed, is that simply labeling something in a record contract as a \u2018work made for hire\u2019 or that it will be owned by the recording company \u2018from inception\u2019 does not make it so.\u201d<\/p>\n<p>That line hits at the heart of decades worth of label contracts. <a href=\"https:\/\/allhiphop.com\/news\/salt-n-pepa-masters-umg-case\/\">Reporting from AllHipHop<\/a> has pointed out that this lawsuit is part of a larger wave of artists revisiting old deals, especially as catalogs become way more valuable in the streaming era.<\/p>\n<p>Salt-N-Pepa\u2019s case stands out because it directly challenges how labels have used \u201cwork made for hire\u201d claims to hold onto ownership.<\/p>\n<p>The irony here is impossible to miss.<\/p>\n<p>The same legal tool now helping Salt-N-Pepa build pressure on UMG could also help the label in another major dispute.<\/p>\n<p>In UMG\u2019s ongoing fight tied to Drake and Kendrick Lamar\u2019s \u201cNot Like Us,\u201d multiple lawyers filed amicus briefs supporting the label, which means while amicus support could weaken UMG\u2019s position in this case, it could strengthen the company in another courtroom at the same time.<\/p>\n<p><h3 class=\"jp-relatedposts-headline\"><em>Related<\/em><\/h3>\n<\/p>\n<p>\t\t\t<!-- CONTENT END 1 --><\/p><\/div>\n<p><br \/>\n<br \/><a href=\"https:\/\/allhiphop.com\/news\/exclusive-powerful-lawyers-back-salt-n-pepa-in-epic-battle-with-umg\/\">Source link <\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Salt-N-Pepa gets major legal backing in their UMG masters fight, with lawyers arguing the case could reshape how artist ownership works in the music industry.
